Support Open Access: Contact House Judiciary Committee Members to Save the NIH Public Access Policy

As indicated in recent postings ("Fair Copyright in Research Works Act: Ten Associations and Advocacy Groups Send Letter to Judiciary Committee Members Opposing Act" and "Urgent Call to Action: Conyers Bill Opposing NIH Open Access Policy May Soon Come to House Vote"), the fight over the Fair Copyright in Research Works Act (H.R. 801) is heating up.

If you want to oppose the bill and support the NIH Public Access policy and open access, you should contact members of the House Judiciary Committee and your Representative immediately by letter, e-mail, fax, or phone. If a Judiciary Committee member is in your district, your opposition will have considerably more impact. If you are uncertain, about who your House member is, you can use the The Hill's search form to find out. The "Contact" tab for the House member's The Hill record, includes a "Contact [Congressional representative] via Web Form" function that can be used to send e-mail messages.

On behalf of [your organization], I strongly urge you to oppose H.R. 801, “the Fair Copyright in Research Works Act,” introduced to the House Judiciary Committee on February 3, 2009. This bill would amend the U.S. Copyright Code, prohibiting federal agencies from requiring as a condition of funding agreements public access to the products of the research they fund. This will significantly inhibit our ability to advance scientific discovery and to stimulate innovation in all scientific disciplines.

Fair Copyright in Research Works Act: Ten Associations and Advocacy Groups Send Letter to Judiciary Committee Members Opposing Act

Ten associations and advocacy groups, including AALL, ACRL, ALA, ARL, and GWLA, have sent a letter to House Judiciary Committee members opposing the Fair Copyright in Research Works Act (H.R. 801).

The U.S. government funds research with the expectation that new ideas and discoveries from the research will propel science, stimulate the economy, and improve the lives and welfare of Americans. Public support for science is enhanced when the public directly sees the benefits from our nation's investment in scientific research. Yet H.R. 801 would reverse the only U.S. policy for public access to research, at the National Institutes of Health (NIH), and make it impossible for other agencies to enact similar policies.

Scientific research is advanced by broad dissemination of knowledge, and the subsequent building upon the work of others. To this end, the NIH Public Access Policy ensures that the results of our nation's $29 billion annual investment in research reach the broadest possible audience. The Policy requires that, in exchange for receiving federal research dollars, grantees deposit the final electronic manuscript of their peer-reviewed research results into PubMed Central, NIH’s digital archive, to be made publicly available within 12 months—and was specifically implemented in full compliance with current U.S. copyright law.

The NIH Policy achieves several notable goals: First, it ensures broad public access to the results of NIH's funded research, allowing scientists and researchers to collaborate and engage in cutting-edge research. Such access allows for greater sharing of information, speeding discovery, medical advances, and innovations.

Second, the NIH Policy ensures that the U.S. government has a permanent archive of these critical, publicly funded biomedical research results, ensuring that results can be built upon by not only this generation, but also future generations, of researchers.

Finally, the Policy creates a welcome degree of accountability and transparency, which enable us to better manage our collective investments in the NIH research portfolio and ensure the maximum possible benefits to the public in return.

At the direction of Congress, the NIH Public Access Policy, in place as a voluntary measure since 2005, was recently strengthened to a mandatory policy. As a result, the rate of eligible manuscripts being deposited for public accessibility quickly increased from 19% to 60%. This requirement proved crucial to ensuring that the more than 80,000 articles resulting from NIH funding each year are, for the first time, available to any researcher, physician, faculty member, student, or member of the public who wants them.

H.R.801 presupposes that the NIH Public Access Policy undermines the rights of the author and conflicts with U.S. copyright law. As library organizations and allies we fully respect copyright law and the protection it affords content creators, content owners, and content users. NIH-funded research is copyrightable and copyright belongs to the author. The NIH Policy requires only the grant of a non-exclusive license to NIH, fully consistent with federal policies such as Circular A- 110 and Circular A-102. This policy leaves the author free to transfer some or all of the exclusive rights under copyright to a journal publisher or to assign these anywhere they so choose. Attached please find an issue brief detailing how the NIH Public Access Policy does not affect copyright law [see the letter for the brief].

The NIH Public Access Policy advances science, improves access by the public to federally funded research, provides for effective archiving strategies for these resources, and ensures accountability of our federal investment. Given the proven success of the revised NIH Public Access Policy and the promise of public access to federally funded research, we firmly oppose H.R.801 and ask that you do the same. Thank you for considering the stake and position of the key constituencies in this discussion.

Urgent Call to Action: Conyers Bill Opposing NIH Open Access Policy May Soon Come to House Vote

There are strong indications that Rep. John Conyers, Jr. will try to get a House vote on the Fair Copyright in Research Works Act (H.R. 801) much more quickly than previously thought. If you want to oppose the bill and support the NIH Public Access policy, you should contact members of the House Judiciary Committee and your Representative immediately by e-mail, fax, phone, or letter. This is especially important if a Judiciary Committee member is in your district.

Here's an excerpt from the Alliance for Taxpayer Access call to action to defeat the Conyers bill:

All supporters of public access—researchers, libraries, campus administrators, patient advocates, publishers, and others—are asked to please contact your Representative . . . to express your support for public access to taxpayer-funded research and ask that he or she oppose H.R.801. Draft letter text is included below. . . .

H.R. 801 is designed to amend current copyright law and create a new category of copyrighted works (Section 201, Title 17). In effect, it would:

  1. Prohibit all U.S. federal agencies from conditioning funding agreements to require that works resulting from federal support be made publicly available if those works are either: a) funded in part by sources other than a U.S. agency, or b) the result of "meaningful added value" to the work from an entity that is not party to the agreement.
  2. Prohibit U.S. agencies from obtaining a license to publicly distribute, perform, or display such work by, for example, placing it on the Internet.
  3. Stifle access to a broad range of federally funded works, overturning the crucially important NIH Public Access Policy and preventing other agencies from implementing similar policies.
  4. Because it is so broadly framed, the proposed bill would require an overhaul of the well-established procurement rules in effect for all federal agencies, and could disrupt day-to-day procurement practices across the federal government.
  5. Repeal the longstanding "federal purpose" doctrine, under which all federal agencies that fund the creation of a copyrighted work reserve the "royalty-free, nonexclusive right to reproduce, publish, or otherwise use the work" for any federal purpose. This will severely limit the ability of U.S. federal agencies to use works that they have funded to support and fulfill agency missions and to communicate with and educate the public.

ARL, AAU, CNI, and NASULGC Release "The University’s Role in the Dissemination of Research and Scholarship—A Call to Action"

The Association of Research Libraries, the Association of American Universities, the Coalition for Networked Information, and the National Association of State Universities and Land-Grant Colleges, have released "The University’s Role in the Dissemination of Research and Scholarship."

Primary Recommendation: Campuses should initiate discussions involving administration and faculty about modifying current practices and/or its intellectual property policies such that the university retains a set of rights sufficient to ensure that broad dissemination of the research and scholarly work produced by its faculty occurs. . . .

Some specific institutional strategies include:

  • Initiate a process to develop an institutional dissemination plan by explicitly evaluating existing dissemination activities, policies relating to promotion and tenure, and policies regarding faculty copyrights. For instance, charge a campus blue ribbon task force to advise the provost on key issues raised by the emergence of new forms of scholarly publishing and the gains that might be had by utilizing more effective ways of sharing the high quality results of the processes of scholarly and creative endeavor.
  • With this foundation, develop priorities for supporting new dissemination strategies that enhance the value of the multifaceted investments in faculty research and scholarship by promoting the broadest possible access to it.
  • Engage departments on campus in developing fresh articulations of the criteria that are appropriate for judging the quality of contributions to their discipline, criteria that embrace emerging forms of scholarly work, where those possess the same attributes of quality and contribution to new knowledge, and do not rely solely on traditional publications and historic practices.
  • Develop institutional policies that enable the university to disseminate the full range of its community’s products now and in the future.
  • Where local dissemination infrastructure exists (such as institutional repositories), promote its use and expand its capabilities as required. Where needed, build new infrastructure that supports documentation of the products of faculty work, both for grant management and compliance and for more general purposes.
  • Seek opportunities to invest in shared dissemination infrastructure with other institutions – through shared facilities or by contributing funds to the development of dissemination services by another institution.
  • Encourage faculty authors to modify contracts with publishers so that their contracts permit immediate open access or delayed public access to peer reviewed work in a manner that does not threaten the viability of the journals or monographs.
  • Develop policies or strategies that redirect resources from high cost /low value dissemination practices to development of dissemination mechanisms residing inside the academy.
  • Where universities support presses, work to realign presses more directly with the university mission. Encourage press investments in dissemination activities that correspond to areas of excellence on campus. Consider revising reporting relationships to encourage collaboration between presses and libraries. Invest in press/library collaborations.

Fair Copyright in Research Works Act: Bill Opposing Open Access Reintroduced in House

Rep. John Conyers has reintroduced the Fair Copyright in Research Works Act (H.R. 801) in the House.

Here's an excerpt from Peter Suber's posting:

The Fair Copyright Act is to fair copyright what the Patriot Act was to patriotism.  It would repeal the OA policy at the NIH and prevent similar OA policies at any federal agency.  The bill has been referred to the House Judiciary Committee, where Conyers is Chairman, and where he has consolidated his power since last year by abolishing the Subcommittee on Courts, the Internet, and Intellectual Property.  The Judiciary Committee does not specialize in science, science policy, or science funding, but copyright. 

The premise of the bill, urged by the publishing lobby, is that the NIH policy somehow violates copyright law.  The premise is false and cynical.  If the NIH policy violated copyrights, or permitted the violation of copyrights, publishers wouldn't have to back this bill to amend US copyright law.  Instead, they'd be in court where they'd already have a remedy.  For a detailed analysis of the bill and point by point rebuttal to the publishing lobby's rhetoric, see my article from October 2008.

Harvard University Press Launches Open Access Law Journal

The Harvard University Press has launched the Journal of Legal Analysis, an open access journal published under a Creative Commons Attribution-Noncommercial-Share Alike 3.0 Unported License.

A couple things make the JLA different than the average law journal. First, it's online. At the end of each year, articles will be bundled, printed, and sold to those who wish to procure such a volume, but the focus is on the website, where all articles will be posted, for free, as soon as they are ready for publication. In addition, we're hoping the journal fills a gap in the legal publishing landscape by providing a peer-reviewed, faculty-edited journal that covers the entire academy. In the words of Editor-in-Chief Mark Ramseyer: "Until JLA, there has not been a faculty-edited, peer-reviewed journal that covered the whole span of the legal academy. There have been faculty-edited journals for subfields, but not for the entire discipline. With the JLA, we are trying to create a faculty-edited journal that will be the flagship journal for the law school faculty as a whole."

Rufus Pollock on Open Data and Licensing

In "Open Data Openness and Licensing," Rufus Pollock, a Cambridge University economist, tackles the question of whether open research data should be licensed.

Over the last couple of years there has been substantial discussion about the licensing (or not) of (open) data and what "open" should mean. In this debate there two distinct, but related, strands:

  1. Some people have argued that licensing is inappropriate (or unnecessary) for data.
  2. Disagreement about what "open" should mean. Specifically: does openness allow for attribution and share-alike "requirements" or should "open" data mean "public domain" data?

These points are related because arguments for the inappropriateness of licensing data usually go along the lines: data equates to facts over which no monopoly IP rights can or should be granted; as such all data is automatically in the public domain and hence there is nothing to license (and worse "licensing" amounts to an attempt to "enclose" the public domain).

However, even those who think that open data can/should only be public domain data still agree that it is reasonable and/or necessary to have some set of community "rules" or "norms" governing usage of data. Therefore, the question of what requirements should be allowed for "open" data is a common one, whatever one"s stance on the PD question.

Economic Implications of Alternative Scholarly Publishing Models: Exploring the Costs and Benefits

JISC has released Economic Implications of Alternative Scholarly Publishing Models: Exploring the Costs and Benefits.

Sharing research information via a more open access publishing model would bring millions of pounds worth of savings to the higher education sector as well as benefiting UK plc. This is one of the key findings from a new research project commissioned by JISC.

Professor John Houghton from the Centre of Strategic Economic Studies at Melbourne’s Victoria University and Professor Charles Oppenheim at Loughborough University were asked to lead research that would throw light on the economic and social implications of new models for scholarly publishing.

The research centred on three models which include:

  • Subscription or toll access publishing which involves reader charges and use restrictions;
  • Open access publishing where access is free and publication is funded from the authors’ side; and
  • Open access self-archiving where academic authors post their work in online repositories, making it freely available to all Internet users.

In their report, Houghton et al. looked beyond the actual costs and savings of different models and examined the additional cost-benefits that might arise from enhanced access to research findings.

The research and findings reveal that core scholarly publishing system activities cost the UK higher education sector around £5 billion in 2007. Using the different models, the report shows, what the estimated cost would have been:

  • £230 million to publish using the subscription model,
  • £150 million to publish under the open access model and
  • £110 million to publish with the self-archiving with peer review services plus some £20 million in operating costs if using the different models.

When considering costs per journal article, Houghton et al. believe that the UK higher education sector could have saved around £80 million a year by shifting from toll access to open access publishing. They also claim that £115 million could be saved by moving from toll access to open access self-archiving.

In addition to that, the financial return to UK plc from greater accessibility to research might result in an additional £172 million per annum worth of benefits from government and higher education sector research alone.

Max Planck Institute Releases Best Practices for Access to Images: Recommendations for Scholarly Use and Publishing

The Max Planck Institute for the History of Science has released Best Practices for Access to Images: Recommendations for Scholarly Use and Publishing.

The recommendations were prompted by the barriers encountered by those who wish to use and publish images of cultural heritage objects. High licence fees and complicated access regulations make it increasingly difficult for scholars in the humanities to work with digital images. It is true that the digitization of image collections has acted as a catalyst for scholarly research. However, archives, collections and libraries differ greatly with respect to the question of how, where and on what basis images may be used for scholarly purposes. Moreover, their policies in this regard are becoming increasingly restrictive, especially when it comes to new forms of e-publishing.

The MPIWG drew up its recommendations for facilitating the scholarly use of digital images following consultations with international experts which took place in January 2008. The recommendations call on curators and scholars to develop a mutually binding network of trust. The aim of the initiative is to encourage stakeholders jointly to address the current and future challenges raised by the digital age. The document urges curators to refrain from restricting the public domain arbitrarily and calls on them to accommodate the needs of scholars for reasonably-priced or freely-accessible high-resolution digital images—both for print publications and new Web-based forms of scholarly publishing. It exhorts scholars to recognise museums, libraries and collections as owners and custodians of physical objects of cultural heritage and to acknowledge their efforts in making digital images available. Moreover, it urges them to take their role as guarantors of authenticity and accurate attribution extremely seriously.

Clarifications about the Michigan/OCLC OAIster Deal

University of Michigan and OCLC Form OAIster Partnership

The University of Michigan and OCLC will jointly support the OAIster search engine for open access documents.

Launched in 2002 with grant support from the Andrew W. Mellon Foundation, OAIster was developed to test the feasibility of building a portal to open archive collections using the Open Archives Initiative Protocol for Metadata Harvesting (OAI-PMH). OAIster has since grown to become one of the largest aggregations of records pointing to open archive collections in the world with over 19 million records contributed by over 1,000 organizations worldwide.

Under the partnership, OAIster.org will continue to function as the public interface to OAIster collections, through funding provided by OCLC to the University of Michigan. Later in 2009, metadata harvesting operations will transfer from the University of Michigan to OCLC. . . .

Starting in late January 2009, while OAIster continues to be freely available at the www.oaister.org Web site, OCLC will host a version of OAIster on OCLC's FirstSearch platform and make it available through subscriptions to the FirstSearch Base Package at no additional charge.

University of California Affiliated Authors Will Be Able to Publish Using Springer Open Choice as Part of Journals License

Under the terms of the journals license negotiated by the California Digital Library for the University of California Libraries, UC-affiliated authors will be able to publish in Springer journals using the Springer Open Choice option without paying additional publication fees. There will be no separate per-article charges, since costs have been factored into the overall license. Articles will be released under a license compatible with the Creative Commons (by-nc: Attribution, Non-commercial) license. In addition to access via the Springer platform, final published articles will also be deposited in the California Digital Library's eScholarship Repository.

The University of California-Springer agreement is the first large-scale open access experiment of its type undertaken with a major commercial publisher in North America.

"UC faculty members have told us that they want open access publishing options in order to increase the impact of their published work and eliminate barriers to educational and research use," said Ivy Anderson, director of collections for the California Digital Library, which licenses content on behalf of the University of California libraries. "Just as importantly, they want these options in the journals in which they routinely publish, without disrupting their normal research activity. The CDL agreement with Springer supports the transformation that our faculty seeks, while continuing the libraries' crucial role in facilitating access to research information. Springer is a leader among commercial publishers in open access experimentation, making it a natural partner for the University of California in this endeavor."

Deepening our understanding of our Nation and its culture and history, advancing scientific discovery, tackling environmental, economic issues and more, all depend on scientists, researchers, students, scholars, and members of the public accessing our Nation's cultural, historical and scientific assets. A large-scale initiative to digitize and preserve the public domain collections of library, governmental, and cultural memory organizations will support research, teaching and learning at all levels, will help stem the current economic crisis by equipping and employing workers in every state with 21st Century skills, and it will lay a foundation for innovation and national competitiveness in the decades ahead. The goal is to establish a universal, open library or a digital data commons.

Updated ACRL Scholarly Communication Toolkit Released

The Association of College and Research Libraries has released an updated version of its Scholarly Communication Toolkit. It has been released under a Creative Commons Attribution-Noncommercial-Share Alike 3.0 United States License.

The toolkit continues to provide context and background by summarizing key issues to offer quick, basic information on scholarly communication topics. It also links to examples of specific tools, including handouts, presentations and videos for libraries to adapt and use on their own campuses. . . .

“Given the current economic climate, it's natural to ask if scholarly communication activities are a luxury or a distraction,” said Richard Fyffe, librarian of the college for Grinnell College and co-chair of ACRL’s Scholarly Communication Committee. “We define scholarly communications issues as central to the mission of virtually every kind of academic library because they are central to the mission of our institutions. We feel libraries need to maintain a commitment to awareness, understanding, ownership and activism.”

The updated toolkit serves as a resource for scholarly communication discussions inside the library, outreach programs to faculty and administrators and library school students seeking to incorporate these issues into their course work. The ACRL Scholarly Communication Committee, as part of its efforts to keep the toolkit current, encourages librarians to contribute tools and case studies on their local scholarly communication campaigns. Stanford's HighWire Press Hits 5 Million Article Mark

With the addition of a backfile 1884 article, "Dermatitis Herpetiformis," in JAMA: The Journal of the American Medical Association, HighWire Press, a division of the Stanford University Libraries, hit the five million article mark. Over two million of those articles are freely available.

Digital Library Software: Greenstone Version 2.81 Released

Version 2.81 of the Greenstone digital library software has been released.

Here's an excerpt from the home page that describes Greenstone:

Greenstone is a suite of software for building and distributing digital library collections. It provides a new way of organizing information and publishing it on the Internet or on CD-ROM. Greenstone is produced by the New Zealand Digital Library Project at the University of Waikato, and developed and distributed in cooperation with UNESCO and the Human Info NGO. It is open-source, multilingual software, issued under the terms of the GNU General Public License.

Concord Free Press: It Really Means Free

The Concord Free Press gives away its printed books for free, shipping included, but asks for a donation to a charity of the reader's choice. Initially, it will publish two books a year, with a print run of about 1,000 copies each. Selected independent bookstores carry its books.

Writers are unpaid, and the press relies on "on donations from our Advisory Board and supporters—and sales of our stylish t-shirts."
